**Tax Deduction Notification
  
Federal law requires Indiana HBPA to provide all members with a written estimate of what portion of membership dues goes to lobbying and political action expenses.  For 2019 the amounts spent for lobbying and political action expenses exceeded the amount of the dues collected.  Therefore, none of the dues paid by Indiana HBPA members in 2019 will be allowable as a business expense for federal income tax purposes.  The same federal law requires Indiana HBPA to give its members an estimate of the 2020 lobbying and political action expenses that are considered to be paid from dues.  It is anticipated that the 2020 expenditures for lobbying and political action expenses will again exceed the amount of dues collected for the year.  Therefore, none of the dues paid by Indiana HBPA members in 2020 will be allowable as a business expense for federal income tax purposes.  Members are encouraged to consult a tax professional about individual and business tax returns and liability.                        Click for printable pdf

In 2016, the Indiana Horse Racing Commission will not be endorsing or publishing withdrawal times or thresholds.  The Commission adheres to the ARCI/RMTC research and publications regarding withdrawal times and thresholds, but they caution horsemen and women that these are simply guidelines.

Withdrawal Guidelines
The information contained in this publication is provided as a public service and intended for general use.  These withdrawal guidelines are the recommendations of an independent third party (RCI/RMTC).

Any person following these withdrawal guidelines does so at their own risk. The IHRC enforces the adopted thresholds without regard to RCI/RMTC’s withdrawal guidelines. All trainers are responsible for any drug positives over the HRC’s adopted thresholds.

Indiana participates in the RCI/RMTC National Uniform Medication Program.  By clicking here ( http://rmtcnet.com ) you will be taken to the RMTC’s website.  From there, you will need to click on the Withdrawal Times Database.  After agreeing to the disclaimer, you will be taken to the list of therapeutic drugs. You will need to filter the list to see those relevant to Indiana.  Included with this list is the recommended administration and route of administration.  Please read the warning at the beginning and note the footnotes at the bottom of each page regarding disclaimers.

Trainer Initiated Testing
Trainers should remember that they have the option to send blood samples from any horse in their stable to the lab.  Industrial Laboratories, IHRC’s primary testing laboratory offers a therapeutic medication research program.  This program provides a resource for veterinarians and horsemen to obtain clearance time information for controlled therapeutic medications that is dose-specific, administration specific, and horse specific.

Cobalt testing is available through the University of Kentucky Veterinary Diagnostic Laboratory.  Information about this testing program is available below.  Additionally, if you have any questions about our testing programs, please contact the IHRC offices and one of our Test Barn Administrators will be happy to assist you.

Proof of Worker’s Compensation Insurance Required
Horsemen and women racing in Indiana should pay special attention to the Indiana Horse Racing Commission’s (IHRC’s) recently announced policy on worker’s compensation insurance verification.  Beginning July 15, 2012, trainers must provide a certificate of insurance in order to show that his or her employees are covered by worker’s compensation insurance.

The certificate must include the IHRC as a certificate holder. The Certificate of Insurance can be provided in person at the time of licensure or by mail prior to licensure. If provided by mail, you should make sure that the certificate is on file at the racetrack commission office at least seven days prior to your first start.

Trainers without employees will be asked to sign an affidavit attesting that they have no employees requiring coverage.  Those trainers may be required to provide a State of Indiana Worker’s Compensation “Clearance Certificate” for each worker who does not require coverage.  Applications for a clearance certificate and applicable instructions are available online at www.in.gov/wcb/2328.htm.

The IHRC has emphasized that it is the responsibility of the trainer/employer, not of the Worker’s Compensation Board or the IHRC, to determine whether an employment relationship must be covered in Indiana.  For further information, contact your private insurance carrier/agent.  If needed, you can reach the Indiana Worker’s Compensation Board at (317) 232-3808, or at www.in.gov/wcb.

I-9 compliance
It is vital that all trainers demonstrate they are in compliance with federal Form I-9 requirements.  All U.S. employers must complete and retain a Form I-9 for each individual they hire for employment in the United States. This includes citizens and non-citizens.  This is as much for your protection as it is for compliance to regulations.


On the I-9, the employer must examine the employment eligibility and identification document(s) an employee presents, to determine whether the documents reasonably appear to be genuine and relate to the individual, and record the information on the Form I-9.  The list of acceptable documents can be found on the last page of the form.

To verify compliance, the IHRC will require trainers to produce the completed I-9’s for inspection if a written complaint has been filed or as otherwise deemed appropriate.

IHRC Changes Continuing Education Requirement

Trainer or Designee Must be Present at Salix Administration
All trainers are responsible to have a licensed representative with each horse on race day at the time of Salix administration. The representative must be available from one hour prior to the scheduled post time for the race until Salix is administered.  The penalty for non compliance is: 1st offense — Written warning (ruling); 2nd offense — $250 fine; and,  3rd offense — $500 fine & scratch.

IHRC Lowers Bute Thresholds and Eliminates Calcium and B1
The IHRC has unanimously voted to reduce the threshold of phenylbutazone (bute) allowable in post-race samples from 5 micrograms per milliliter of serum to 2 micrograms per milliliter of serum. This change comes one full year after extensive debate by regulatory veterinarians, the Association of Racing Commissioners International (RCI), and the Racing Medication and Testing Consortium (RMTC).  The withdrawal time for bute will remain at 24 hours.

Also, in accordance with a new national model rule permitting furosemide (salix) as the only drug to be administrated on race day, the IHRC has decided to prohibit the administration of calcium and vitamin B1.
